This privacy policy applies to the Fizzik app (hereby referred to as “Application”) for mobile devices that was created by Daitoku Corp. (hereby referred to as “Service Provider”) as a Freemium service. This service is intended for use “AS IS”.
Information Collection and Use
The Application collects information when you download and use it. This information may include:
- Your device’s Internet Protocol address (e.g. IP address);
- The actions you take in the Application, such as the requests your device makes to our servers, and the time and date of those requests;
- The amount of time you spend in the Application;
- The operating system and device information you use on your mobile device.
The Application does not gather precise information about the location of your mobile device. The “Tilt” simulation reads your device’s motion sensors (such as the accelerometer and gyroscope) on your device, in real time, to move the on-screen marbles; this motion data is not location data, is not stored, and is not transmitted to the Service Provider.
The Application does not use Artificial Intelligence (AI) technologies to process your data or provide features, and the Service Provider does not use third-party advertising or analytics trackers.
The Service Provider may use the information you provide to contact you from time to time to provide you with important information, required notices, and, where permitted, occasional product updates. You can opt out of non-essential messages at any time.
For a better experience, and in order to operate the Application, the Service Provider collects and retains certain information, including but not limited to:
- Account and identity — your Sign in with Apple identifier, an optional Apple private relay email address, an app-specific account token, and the username you choose. Your username is shown publicly on any creation you publish.
- Your creations — the simulations you make (their names and settings), whether you mark them as favorites, and, if you choose to publish or share them, their public name, share codes, and creator attribution.
- Explore activity — which creations you publish, like, save, and view, and the engagement counts derived from these actions.
- Subscription information — your Fizzik Pro subscription status and the App Store transaction details Apple provides to us (such as transaction and product identifiers, purchase and expiration dates, and the store environment). We never receive or store your payment card details.
- Security and anti-abuse data — device attestation data (Apple App Attest keys and receipts), hashed session tokens, an encrypted copy of your Apple authorization used only to revoke it when you delete your account, and technical request data (such as your IP address) used to rate-limit and protect the service.
- Account timestamps — such as account creation time and last login time.
Some of this information is also stored locally on your device (for example, your simulations, generated thumbnails, and app settings). Videos you export are saved only where you choose, such as your device’s photo library, and are not uploaded to the Service Provider.
Publicly Shared Information
Fizzik includes an Explore feed. When you publish a creation, its name and your username become visible to other Fizzik users, who can view, like, and save their own copy to remix. Copies that other users save belong to them and retain an attribution snapshot of your username. Because those copies live in other users’ accounts, they — and that attribution — may remain available even after you unpublish the original creation, delete it, or delete your account. You should only publish content and use a username that you are comfortable making public.
Third Party Access
Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.
To deliver the Application, the Service Provider relies on Apple (for Sign in with Apple, the App Store and StoreKit, and App Attest) and on its cloud hosting and database provider, which store and process data on the Service Provider’s behalf under contract.
The Service Provider may disclose User Provided and Automatically Collected Information:
- as required by law, such as to comply with a subpoena, or similar legal process;
- when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- with their trusted service providers who work on their behalf, do not have an independent use of the information disclosed to them, and have agreed to adhere to the rules set forth in this privacy statement.
The Service Provider does not sell your personal information, and does not share it for cross-context behavioral advertising.
Opt-Out Rights
You can stop all collection of information by the Application easily by deleting your account and uninstalling the app. You may use the delete-account button located in the Settings of the Application, as well as the standard uninstall processes available through your mobile device or the app marketplace. You can also unpublish or delete individual creations at any time, and manage or cancel your subscription through your Apple Account settings.
Your Privacy Rights
Depending on where you live, you may have the right to access, correct, export, or delete the personal information associated with your account, and to object to or restrict certain processing. You can exercise many of these rights directly in the Application (for example, editing your username, unpublishing a creation, or deleting your account), or by contacting the Service Provider at help@fizzik.app. We will not discriminate against you for exercising these rights.
If you are a resident of Canada, the Service Provider handles your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws; you may contact us to access or correct your information or to raise a concern. If you are located in the European Economic Area or the United Kingdom, the Service Provider processes your information to perform its contract with you (to provide the Application), for its legitimate interests in operating, securing, and improving the service and preventing abuse, and, where required, with your consent. If you are a California resident, note that we do not sell or share your personal information as those terms are defined under California law.
Data Retention Policy
The Service Provider will retain your personal information for as long as your account is active or as needed to provide the Application. When you delete your account, we delete or de-identify the personal information associated with your account and revoke Fizzik’s Sign in with Apple authorization, unless we are required to retain certain information for legal, security, fraud-prevention, or legitimate business purposes.
Because some creations are shared and can be saved by other users, deleting your account may not automatically delete copies that other users have saved. In that case, we will remove or de-identify your personal account information from those shared records where feasible, but a saved copy may continue to be available to the other user.
If you would like to request deletion of personal information you have provided through the Application, please contact us at help@fizzik.app. We will respond within a reasonable time.
International Data Transfers
The Service Provider and its providers may store and process your information on servers located in countries other than the one in which you live, including the United States. Where information is transferred internationally, the Service Provider takes steps to ensure it is treated in accordance with this privacy policy and applicable law.
Children
The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.
The Service Provider does not knowingly collect personally identifiable information from children. The Service Provider encourages all children to never submit any personally identifiable information through the Application and/or Services. The Service Provider encourages parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide personally identifiable information through the Application and/or Services without their permission. If you have reason to believe that a child has provided personally identifiable information to the Service Provider through the Application and/or Services, please contact the Service Provider (help@fizzik.app) so that they will be able to take the necessary actions. You must also be at least 16 years of age to consent to the processing of your personally identifiable information in your country (in some countries we may allow your parent or guardian to do so on your behalf).
Security
The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains. For example, session tokens are stored only as hashes, and your Apple authorization is stored in encrypted form. However, no method of transmission or storage is completely secure, and the Service Provider cannot guarantee absolute security.
Changes
This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
This privacy policy is effective as of July 15, 2026.
Your Consent
By using the Application, you are consenting to the processing of your information as set forth in this Privacy Policy now and as amended by us.
